Terms and Conditions

1. Area of Application

These terms govern all orders placed via the online shop of DynamicNord Middle East, Asia & Africa, for both consumers and businesses. A consumer is defined as any natural person conducting transactions outside their trade or profession. A business is a natural or legal person acting within their professional capacity. Conflicting terms from businesses are rejected unless expressly agreed upon in writing.

2. Contracting Parties, Contract Conclusion, Corrections

The contract is with DynamicNord Middle East, Asia & Africa, registered and operating from Dubai Maritime City, Workshop W500B WS533, Dubai, UAE. Product listings constitute a binding offer. Customers may modify their shopping basket before submitting an order. The contract concludes upon clicking the order confirmation button. An order confirmation is sent by email immediately.

3. Language of Contract, Contract Storage

The contract language is English. Order details and contract text are sent via email upon order confirmation. The contract text is not separately stored and accessible via the website for security reasons.

4. Subject Matter of the Contract

4.1 Product Description

Product descriptions displayed on the website are integral components of the contract.

4.2 Product Illustrations

Colour variations may occur between screen displays and actual products due to individual screen configurations (resolution, brightness, calibration). Customers should contact us for clarifications before purchase.

5. Delivery Conditions

5.1 Delivery Charges

Delivery charges may apply depending on order value and destination, and are detailed in individual product listings and at checkout.

5.2 Delivery Options

Products are shipped to the delivery address provided at checkout. In-store collection may be arranged by prior appointment at our Dubai facility.

6. Payment

6.1 Due Date and Default

The full price is due upon contract conclusion unless otherwise specified. Late or failed payments may result in order cancellation. Additional legal claims remain unaffected.

7. Right of Cancellation

Consumers have the right to cancel an order within 14 days of receiving the goods, provided the items are unused and in their original condition and packaging. To initiate a return, please contact us at Info@dynamicnord.asia or call 04 553 8927.

8. Retention of Title

DynamicNord Middle East, Asia & Africa retains ownership of all goods until full payment is received. In the case of business customers, ownership is retained until all outstanding claims from the ongoing business relationship are settled.

9. Transport Damage

For Consumers: Any visible transport damage must be reported immediately to the delivery courier and to DynamicNord Middle East, Asia & Africa. Non-compliance does not affect your statutory rights but assists in processing carrier claims.

For Businesses: Risk of loss or damage transfers upon handover of goods to the shipping carrier or courier.

10. Data Backup

Customers are responsible for maintaining regular backups of any data relevant to their account or orders. DynamicNord Middle East, Asia & Africa is not liable for data losses that could have been prevented through regular backups, except where caused by gross negligence or wilful misconduct on our part.

11. Warranty and Guarantees

11.1 Warranty for Defects

Statutory warranty laws applicable under UAE law apply to all products sold. Defective items may be repaired, replaced, or refunded at our discretion.

12. Liability

DynamicNord Middle East, Asia & Africa maintains full liability for injuries caused by wilful misconduct or gross negligence, and for obligations guaranteed under applicable UAE law.

For breaches of material contractual obligations caused by ordinary negligence, liability is limited to foreseeable damages at the time of contract conclusion. All other damage claims are excluded to the extent permitted by law.

13. Dispute Resolution

In the event of a dispute, we encourage customers to contact us directly at Info@dynamicnord.asia to resolve the matter amicably. If a resolution cannot be reached, disputes shall be subject to the jurisdiction of the courts of Dubai, UAE, in accordance with applicable UAE law.

14. Final Provisions

These terms are governed by the laws of the United Arab Emirates. The exclusive jurisdiction for any disputes arising from or in connection with these terms is the courts of Dubai, UAE. Any provisions found to be invalid or unenforceable shall not affect the validity of the remaining provisions.
